Pera questions Lipinski’s FISA vote

In response to the domestic wiretapping program recently approved by Congress, Democrat Mark Pera, who is challenging Lipinski in Illinois’ 3 U.S. Congressional District, has the following statement for release:

On Aug. 5, before he left Washington D.C. for vacation, U.S. Rep. Dan Lipinski gave President Bush and former-Attorney General Alberto Gonzalez permission to run the domestic wiretapping program without judicial oversight.

A Congressman who is aware of the troubles befalling our nation should know by now that this Administration won’t just let the wiretapping program gather dust. We can be sure that sometime during the next six months, President Bush will exercise the power given to him by Congress.

It is shocking to see such blind trust from “Democrats” like Lipinski who willy-nilly throw away  Congress’ own power in deference to a President who has routinely demonstrated to the American people and to Congress that he cannot be trusted.

In my experience as Assistant Cook County State’s Attorney, I requested wiretaps and I respected the  protocol involved in the process, of going to a judge and having a third party sign off on the request. It never impeded my ability to do my job.

It is particularly troubling that Lipinski again capitulated to Bush’s and other Republicans’ blatant use of concerns about terrorism in presenting the proposal. By bucking the Democratic Party and voting with the Republicans, Lipinski has again withered in the face of fear mongering.

This whole issue brings to mind what Benjamin Franklin once said, “The man who trades freedom for security does not deserve nor will he ever receive either.”

What makes Lipinski’s vote that much more egregious is it granted expanded powers to the former Attorney General, someone who has lost credibility with even the staunchest Republicans. The Gonzalez resignation is another reminder that we, the critics of this Administration’s rampant disregard for our Constitutional system, must remain vigilant against a “unitary executive.”

While the Bush Administration and Lipinski claim a high regard for democracy and the rule of law, their actions demonstrate a deep-seated contempt for both. Congressman Lipinski took an oath to up-hold the Constitution but by repeatedly voting in lockstep with the Bush Administration and shirking his responsibility to check presidential power, he has violated that oath and our trust.

A Congressman that understands his responsibility to the American public would do well to remember that two years ago, Americans voted for meaningful, purposeful change. As this FISA vote demonstrates, that demand has fallen upon deaf ears in the 3  District of Illinois.

It’s time to stand up to the President and say ‘No more!’ Dan Lipinski won’t do anything about this Administration; it is time to send someone to Congress who will.

Some background:
The Foreign Intelligence Surveillance Act (FISA) was created in the late-1970s to provide federal oversight of domestic surveillance operations by government agencies. One way of doing so was by requiring that a secret FISA court approve, in advance, any such operations.

After Sept. 11, the Bush Administration — through the Patriot Act — authorized a secret wiretapping program that allowed domestic surveillance by government agencies without prior permission from the FISA courts. In 2005, the New York Times revealed the secret program, which became known as the warrantless wiretapping program, to the public.

When Democrats took over the House in January, the Administration rethought its warrantless wiretapping program and brought it under the oversight of the FISA court.

The FISA court initially ruled that the Administration’s program was appropriate, but when the decision came up for review in the spring, a judge disagreed with the previous ruling. The anonymous judge decided that government agencies needed a warrant to monitor a conversation between parties outside the U.S. when their communications were made via systems within the United States’ communications network

According to U.S. National Intelligence Director Mike McConnell, the government obtained a temporary stay on the ruling. The expiration of the stay on May 31 prompted the Congressional review.

On Aug. 5, by a vote of 227-183, Congress approved a temporary revision of FISA that granted new, wide-ranging powers to Gonzalez and removed a requirement that called for FISA court supervision of certain types of surveillance operations, including those monitoring conversations between parties outsides the U.S. using our nation’s communications network.

Of 231 Democrats in the U.S. House, only 41 voted in favor of the six-month extension. Out of the 202 Republicans in the House, only 2 voted against the proposal.

This issue is not going away. In just five months, legislators will be called upon again to decide whether they want to force the Bush Administration to defend its controversial warrantless wiretapping program or fold in the face of confrontation.

The two most likely Republican nominees, millionaire Jim Oberweis and State Senator Chris Lauzen, are right-wing Republicans who will vote lock step with the Bush Administration and not do anything to change the disastrous policies of Bush and Hastert in Iraq, or here at home.

Nothing would send a stronger message to George Bush and all Republicans who are following his misguided Iraq policy than turning Dennis Hastert’s district blue. Hastert was personally responsible for pushing through every one of George Bush’s policies in the House of Representatives. Now he’s trying to push through his hand-picked successor to maintain the status quo.

Bill Foster is looking to change that. But he can’t do it without our help.

Not Sure Quite What Happened at the Schakowsky Event

But talking to at least two disinterested people, there were no chants of Beltway! Beltway! to Jay Footlik.  One was standing near Jay and his campaign manager and says nothing out of the ordinary happened and most folks were talking politely with Simon and Jay.
To be clear, I’m supporting Dan, but I don’t think we need to be attacking people for things that don’t appear to have happened or at least weren’t noticeable to others who were there.

And for the record, Jay has come out strongly for ending the war in Iraq.

I’m kind of baffled by this kerfluffle.

10th CD Statements on Gonzalez

Out yesterday, potty humor kept them at bay–in order of the way I received them:

Wilmette- Dan Seals released the following statement regarding the resignation of United States Attorney General Alberto Gonzales:

 

“For too long, Bush and his allies have held court in Washington DC where they have continually put politics before policy and the American people.    We need a lawyer for the people, not the Bush Administration.  This is good news for Justice.”

 

Dan Seals is running for Congress in the Tenth District of Illinois to expand opportunity for all Americans and to help get government working again.   As the 2006 Democratic nominee, he raised nearly $2 million and earned 47% of the vote against incumbent Republican Congressman Mark Kirk.    A former Director of Marketing at GE Commercial Finance, he is currently a business consultant.  Dan and his wife Mia live in Wilmette with their three young daughters.

KIRK & BUSH STAND BY GONZALES TIL THE END 

Statement from 10th District Democratic Candidate Jay K. Footlik:

“The resignation of Alberto Gonzales, perhaps the worst Attorney General in U.S. history, is welcome news that is long overdue. While Gonzales is finally gone, the failure of Mark Kirk and other House Republicans to demand his resignation remains an outrage. Mark Kirk’s support for Alberto Gonzales until the bitter end is further evidence that our community needs a new voice in Congress, not a rubberstamp for the failed policies of George W. Bush and the Republicans.”

“The Gonzales legacy will serve as a black cloud over the Justice Department for decades to come.  On his watch, the American people saw their personal liberties encroached upon time and again.  Alberto Gonzales cared more about obeying President Bush than he did the law and his departure is a victory for the American people.”

How Does Roskam Feel About Rush’s Diatribe on Darfur

If you aren’t familiar with the Darfur diatribe, check out Media Matters which is the far left hate site that hates by printing the words of conservative media figures.

Democrats “want to get us out of Iraq, but they can’t wait to get us into Darfur,” Limbaugh said.

He continued: “There are two reasons. What color is the skin of the people in Darfur? It’s black. And who do the Democrats really need to keep voting for them? If they lose a significant percentage of this voting bloc, they’re in trouble.”

A caller responded, “The black population,” to which Limbaugh said, “Right.”

What does this have to do with Peter Roskam? Roskam, to his credit, was a cosponsor of SB 23, which divested the State of Illinois from Sudan. Apparently he just needed black people to vote for him.

The Bush Dogs

I’ve been a supporter of Melissa Bean since 2003 at least and I certainly wouldn’t say that replacing her would end up with a better Member of Congress from IL-8. Also, most readers know I don’t go much for litmus tests for Democratic candidates, but I have to agree with Matt Stoller that we need to do something about the Democratic Congress Members who are passing things like the bankruptcy bill and more importantly, the expanded authority for wiretapping without a warrant under th FISA law.

In the case of IL-8 we aren’t likely to get a full throated progressive, but it’s a significant problem that Bean has voted for issues trying to appear moderate that do not have the support of the political center even in her district. More than that, the 38 people Matt list are mostly in Republican leaning Districts, but even these votes aren’t in the center of these Districts–they are well to the right.

With Bean this is especially relevant. It’s true that her district is more concerned with taxes and budgetary issues than many others, but neither the bankruptcy bill nor the FISA changes are popular. They do get the attention of the Tribune which Bean uses to demonstrate she is a ‘moderate’ and so she ends up seeking their approval on everything. She’s not going to change the triangulation pattern–it’s a winning strategy in that District, but I think she can be moved towards targeting different issues that aren’t nearly as destructive as these. In other cases, we just need to take people out–like Lipinski who is in a 59% Kerry District and votes horribly on just about everything.

However, in the case of Bean and presumably her consultants, we need her to be a strong voice for basic Constitutional Protections–protections gutted by the new version of FISA. We need her to not be voting for a bill that makes those in financial trouble because of sickness or the loss of a job even more vulnerable. We need her to stand up against torture. We need her to stand up against an incredibly unpopular President who not only got us into an unnecessary war, but continues to epically mismanage the war. When she does support such policies, she undermines the reason for Democratic control of Congress and the Presidency, but also, and more importantly, the country.

In a District like Illinois 8 I would never advocate a Democrat try and be Jan Schakowsky. I’ll give them slack on tax and budgetary issues. I’ll give them some slack on social issues to some degree. I’ll give them slack on trade to some degree. But I won’t give them slack on issues of fundamental fairness and Constitutional Rights. These are winning issues in all, but the very most conservative areas and even IL-8 isn’t that conservative. Warrantless wiretapping of American citizens is not a winning issue with the public.

Go out and prove you are a ‘different’ kind of Democrat on some issue like taxes or business issues, but keep the Constitution safe and the same protections for the poorest amongst us that the better off have.

If you cannot stand for these vital principles, then what’s the point?

It is far too early, and in the midst of this August heat, too, to think seriously about the Democratic primary next February. Though The Landmark will never suggest who you might vote for as a presidential candidate, we will, eventually, be hot and heavy in the race for the Third Congressional District. That’s the seat bequeathed to Dan Lipinski some three years ago by his generous-but cynical-father, William Lipinski.

In a hand-off that made Todd Stroger’s ascendency seen downright democratic, Lipinski the Elder anointed his son after winning his party’s 2004 primary and then promptly announcing that he was retiring. Bill Lipinski had pre-greased the wheels with the Democratic committeemen of the Third District on his son’s behalf.

Voila. Dan Lipinski goes to Washington.

Can you tell that it still sticks in our collective craw?

Among the many reasons Chicago and Illinois politics are so corrupt and corrosive is the rampant nepotism at play. This is, after all, a democracy, not a kingdom with royal lineage.

So we’re happy to see that a legitimate challenger is rising up for the February primary in the person of Mark Pera. A Western Springs resident, Pera is known in these parts for his service as president of the Lyons Township High School board. Pera is showing his stuff in two ways. First, he is raising significant cash to take on the lobbyist-larded Lipinski. Pera has even taken out a second mortgage to loan the proceeds to his effort. That though is not the sum total of his fundraising. He has built a network of early support, both financial and grassroots. Second, he is clearly differentiating himself from Lipinski’s political positions on issues such as the war and social issues such as abortion.

It is a good start to what we hope will be a vigorous campaign. Finally Dan Lipinski should be forced to win his seat in Congress legitimately.

Bill Pascoe reemerges! 

One can only hope he likes commercials with helicopters. Or he’s ready to have his candidate lead a siege on the election authority in Kane County. Pascoe, along with Dan Proft brought Keyes to us.

On the other hand, Chris Lauzen, CPA, has received the support of Jack Roeser from the Family Taxpayers Network.

Given the location of the fight, we can only count the days until someone who John Zahm is working for sues someone.

More seriously, Lauzen is siding with the loony wing of suburban politics, while Oberweis appears to be working the inside angle with Berkowitz reporting rumors that Hastert is leaning towards Oberweis.

That’s some legacy he’s leaving behind.
