Am I Being Pollyannish?

Maybe.

I have been busy so the post earlier was a quick reaction to the doom and gloom of the news today.

 

I do have a lot more faith in the jury than just about everyone else at this point, but I also  understand I could be completely wrong.

Where I do think we all ought to be cautious is reading too much into notes written by a jury who are not familiar with legal proceedings or legal language.  I’m not picking on Eric at all given he’s been on the button about the trial on several issues, but he was trying to interpret what the note meant.  The problem is that the jury isn’t filled with people who use words for a living and aren’t likely to put as much thought into their use as we are into analyzing what they mean.

One thing to consider if they haven’t voted on the wire fraud, that’s a lot more significant than one might think.  Part of the RICO and conspiracy to commit racketeering is that the jury must agree on certain acts unanimously fitting the definitions (see here for some discussion on how complicated this might be).  But, and this is important, many of the acts that could be construed to qualify as the RICO predicates are in the wire fraud charges.  So if they haven’t deliberated on those charges, I would hope jurors are somewhat divided on the RICO and conspiracy charges.  If they aren’t some aren’t doing their job of being skeptical.  However, if they start working through each of those wire fraud charges and the pattern starts to emerge in their head, they might be going back to the big counts and changing their minds.

What strikes me is that if they haven’t deliberated on these issues, they might be thinking that they don’t have to because they never bought into the conspiracy charges so the elements aren’t important. However, I would argue that in the end they would find that to be backwards. You may first need to demonstrate the individual acts to have the pattern emerge.

That is why I think the judges instructions to simply go back and look at every charge is so important.  If they simply go through and do what he said, the picture is likely to change in their minds quite a bit.  I’m not of the mind that the prosecutors have done a bad job.  I tend to think this is a very strong case though perhaps structured to not be as friendly to the juror’s minds as it could have been–though the legal process puts limits on that for fairness.

If they come back quickly next week, I’m almost assuredly full of it and Blagojevich is likely to get almost nothing–maybe the lying to the FBI. If it takes a bit, relax and wait and see what happens. The jury may start to put the pieces together after going through each of the 11 wire fraud charges.

All that said, there is a middle possibility as well.  Because Rod Blagojevich is so scattered, the jury may simply not accept that he was a part of an enterprise, but they might find that he committed many of the acts that could lead to racketeering.  In other words, he might get off on RICO and conspiracy and get nailed on every wire fraud charge.

Personally I tend to think RICO is overused, but that Rod Blagojevich is a perfect example of where it does work other than organized crime.  That said, his ‘unique’ personality might have insulated him from the RICO charges.

OMG it’s the End of the World Jury Deadlocked

They must be idiots!

 

Or not.  Turns out they have  decision on two counts, haven’t figured out any of the wire fraud counts and are deadlocked on probably 9 counts.

This is a very complex case with lots of difficult information to go through. I’d be shocked if the jury had decided on many of the complex charges and they largely haven’t.  Even being deadlocked on 9 (or 11) isn’t that big of a deal right now.  What they probably don’t realize is how long this is going to take and a big case like this is that the jury will have to return to some charges and some  probably will come back deadlocked or acquitted.  Instead of panicking or declaring the jurors idiots or the prosecutors incompetent, just wait for it to play out.  The jurors are completely new to this and don’t have the same expectations that we do and they don’t have the same experience and vocabulary for courts meaning they are going to say things that seem strange to many of us who obsess over these matters.

Okay, So My BS Detector isn’t Working Well

I try and give some credit to a Republican candidate and what do we get:

A good laugh was had by all in my clan, and my plan was to report the edits as unfounded and bias. However, a senior member came and reverted the revert (of the revert), as well as making substantive changes to improve the article. thereby remedying the entire situation. He removed commentary, improved citations and increased the readability of the article. Good for him!

Within the last 2 hours, BradyForIllinois came back in a reverted to their version, with this tag

Huh? Possible vandalism? The [real] article now cites Brady’s platform (from his website no less), Chicago Tribune articles that discuss his history and general facts about the man. Yet, this is somehow an issue of…vandalism?

As an Illinois voter, I think it would be downright neat to know about my voting options. Taking on the Family Business is fine and dandy, but not exactly something I care about.I truly hope this is an issue of a campaign manager not understanding how the Internet is supposed to work, rather than an indication of what type of underhanded censorship will come about should this man become Governor.

 

 

What’s funny about this is Rebecca doesn’t appear to be terribly political in a partisan sense, but don’t mess with Wikipedia contributors who know the system.  It’s a pretty strong ethos over there to the point I don’t edit articles because I don’t want to run afoul of the norms over there.

Why So Little on Blagojevich?

Everyone is over analyzing the case.  The Feds have him nailed on most of these counts so thoroughly the press is primarily trying to create a story by talking about different potential weaknesses in the case.  There simply aren’t any weaknesses for most of the charges.  The guilt is so clearly established by both tape and testimony that I just don’t have much to say.

 

One of my favorites is when he told the FBI that he had a firewall between government and fund raising.  The only defense to that is that it was such a completely absurd statement no one would believe him.  Unfortunately for Blagojevich and fortunately for the citizens of Illinois, that’s not a real defense.

The rest of the defense boils down to Blagojevich was too incompetent to pull off most of his schemes.  Again, not a real defense though it is accurate.  He’s going to prison for a long, long time.  Just as I said in 2006.
