The difference between Federal legislation and State legislation is that the issue of abortions will get ‘kicked back’ to the states if Roe v Wade is ever reversed.

That’s the point of conservatives’ introducing legislation like this in State legislatures and why there actually is a rather significant difference between such a statute at the Federal vs State level. In other words, the exact same bill might be “window dressing” on the Federal level but be much more pertinent on the State level.

Committees in the Illinois Senate routinely approve amendments for consideration in committee out of deference to their colleagues. On February 26, 2003, when I presented the amendment to my bill, all 10 committee members voted to add the amendment. However, during the same committee hearing, the committee then rejected the bill as amended – which was identical to the federal legislation that sought to protect babies who survive abortions. It lost on a vote of 4-6.
