In the case of a criminal investigation you don't give people with relationships to the target warning about what you are going to do.  It's a made up privilege that Pelosi and Hastert are trying to assert.  In this case it is a bribery case so the public acts of the official are directly relevant to the investigation.

And specific to the Capitol Police and Sergeant at Arms--they are essentially trained to be deferential to Members--that's not appropriate in cases like this.</description>

Finally, if the FBI had simply gone to the sergeant at arms with their warrant and informed the Majority and Minority leaders (who aren't part of this investigation) and allowed them to be present, I don't think people would be screaming either. There is a protocol to be followed.</description>
